1. What CollabQuick Is

CollabQuick (“we,” “us,” “the Platform”) is operated by Atheric LLC. CollabQuick provides a technology platform that facilitates content creation transactions between creators (“Creators”) and brands or individuals seeking content (“Brands”). We are a payment facilitation and escrow platform — we are not a party to the agreements between Creators and Brands, nor do we provide creative services, marketing services, talent management, or legal advice.

By using CollabQuick, you agree to these Terms of Service. If you do not agree, do not use the Platform.

2. How It Works

For Creators: You create an account, set up content packages with pricing and terms, connect a Stripe account for payouts, and share your unique checkout link with Brands.

For Brands: You visit a Creator's checkout page, select a package, review the auto-generated Content Creation Agreement, and complete payment. By completing payment, you agree to the terms of the Content Creation Agreement displayed at checkout.

Content Creation Agreement: Each transaction generates a Content Creation Agreement between the Creator and the Brand. This agreement is between those two parties — CollabQuick facilitates the agreement but is not a party to it. The terms include deliverables, delivery timeline, revision policy, usage rights, and payment terms as configured by the Creator.

3. Payments and Escrow

All payments are processed through Stripe. When a Brand completes checkout, the full payment amount is held by CollabQuick via Stripe until the order is fulfilled and approved. This is not a traditional escrow service regulated as such — it is a payment hold facilitated through Stripe Connect.

Service Fee: CollabQuick charges an 8% service fee on top of the Creator's listed price. This fee is paid by the Brand and covers payment processing, escrow facilitation, contract generation, and platform operations. The Creator receives 100% of their listed package price upon approval.

Payout Timing: Funds are transferred to the Creator's connected Stripe account when (a) the Brand approves the delivery, or (b) the 72-hour review window expires without action from the Brand (auto-approval). Payouts from Stripe to the Creator's bank account follow Stripe's standard payout schedule.

Stripe's Terms: By using CollabQuick, you also agree to Stripe's Connected Account Agreement and Stripe's Terms of Service.

4. Order Lifecycle and Deadlines

The following rules govern every transaction on CollabQuick:

  • Acceptance Window: Creators have 72 hours to accept a new order. If not accepted within 72 hours, the order is automatically cancelled and the Brand receives a full refund.
  • Delivery Deadline: Creators must deliver content within the timeframe specified in the Content Creation Agreement (default: 7 business days after acceptance). Failure to deliver may result in order cancellation and refund.
  • Review Window: Brands have 72 hours after delivery to approve the content, request one revision, or file a dispute. If no action is taken within 72 hours, the delivery is automatically approved and payment is released to the Creator.
  • Revisions: Brands may request one revision per order within the review window. The Creator may accept or decline the revision request. If declined, the Brand may approve the original delivery or cancel for a full refund.

5. Refunds and Cancellations

Refunds are issued in the following situations:

  • Creator does not accept the order within 72 hours (automatic full refund)
  • Creator declines the order (automatic full refund)
  • Creator fails to deliver within the agreed deadline and the Brand requests cancellation
  • Creator rejects a revision request and the Brand chooses to cancel
  • A dispute is resolved in favor of the Brand

All refunds are for the full amount the Brand paid, including the service fee. Refunds are processed through Stripe and typically appear within 5-10 business days depending on the Brand's payment method and financial institution.

No Refunds After Approval: Once a Brand approves a delivery (or the 72-hour auto-approval window expires), the transaction is final. No refunds will be issued after approval.

6. Disputes

If a Brand is unsatisfied with a delivery, they may file a dispute within the 72-hour review window. When a dispute is filed, funds remain held and CollabQuick will review the case.

CollabQuick reviews disputes based on the Content Creation Agreement terms — primarily whether the Creator delivered what was agreed upon. CollabQuick's dispute resolution is final and binding. We aim to resolve disputes within 48 hours.

If a dispute is resolved in the Brand's favor, a full refund is issued. If resolved in the Creator's favor, funds are released to the Creator. CollabQuick reserves the right to make final determinations on all disputes at our sole discretion.

Chargebacks: Brands agree to use CollabQuick's dispute process rather than filing chargebacks directly with their bank or credit card company. Filing a chargeback instead of using the Platform's dispute resolution may result in account suspension.

7. User Responsibilities

Creators agree to: provide accurate descriptions of their packages and deliverables; deliver content that matches the agreed-upon terms; respond to orders within the acceptance window; comply with all applicable laws including FTC disclosure requirements for sponsored content.

Brands agree to: provide accurate contact and payment information; review deliveries within the review window; use the Platform's dispute process for any issues; not use content beyond the usage rights specified in the Content Creation Agreement without separate agreement with the Creator.

All users agree to: not use the Platform for any unlawful purpose; not circumvent the Platform's payment system; not harass, abuse, or threaten other users; provide accurate information in their profiles and communications.

8. Intellectual Property and Content Rights

Unless otherwise specified in the Content Creation Agreement, the Creator retains all intellectual property rights to content they create. The Brand receives the usage rights specified in the Agreement — by default, the right to repost or share the original post but not to use content in paid advertisements or derivative works without a separate agreement.

CollabQuick does not claim any ownership over content created through the Platform.

9. Limitation of Liability

CollabQuick is a technology platform that facilitates transactions. To the maximum extent permitted by law:

  • We are not responsible for the quality, accuracy, legality, or appropriateness of content created by Creators.
  • We are not responsible for the conduct of any Creator or Brand on or off the Platform.
  • We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform.
  • Our total liability to you for any claims arising from your use of CollabQuick is limited to the amount of fees you have paid to CollabQuick in the 12 months preceding the claim.
  • We provide the Platform “as is” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement.

10. Account Suspension and Termination

CollabQuick reserves the right to suspend or terminate any account at our discretion, including for: repeated disputes or refund requests, fraudulent activity, violation of these Terms, or chargebacks filed outside of our dispute process.

If your account is terminated, any pending orders will be handled on a case-by-case basis. Funds held in escrow will be either released to the Creator or refunded to the Brand as appropriate.

11. Modifications to Terms

We may update these Terms at any time. Material changes will be communicated via email to registered users. Continued use of the Platform after changes constitutes acceptance of the updated Terms. Orders created before a Terms update are governed by the Terms in effect at the time the order was placed.

12. Governing Law

These Terms are governed by the laws of the State of Wisconsin, United States. Any disputes arising from these Terms or your use of CollabQuick shall be resolved through binding arbitration in Madison, Wisconsin, except that either party may seek injunctive relief in a court of competent jurisdiction.
